Safe havens have to do with transporting 1.1, 1.2 and 1.3 explosives. The PC Interpretation allows a driver out-of-hours at a shipper or receiver to proceed to the nearest safe place to park. A driver may only be able to drive for 10 hours on a given day. So a driver cannot run up against the 11/14 hour clock and start looking for a place to park. Drivers know that parking is hard to find after 5:00 PM or so. I believe too many carriers use this Carte Blanc to apply to ANYTIME a driver is out of hours. The time driving under personal conveyance must allow the driver adequate time to obtain the required rest in accordance with minimum off-duty periods under 49 CFR 395.3(a)(1) (property-carrying vehicles) or 395.5(a) (passenger-carrying vehicles) before returning to on-duty driving, and the resting location must be the first such location reasonably available. Time spent traveling to a nearby, reasonable, safe location to obtain required rest after loading or unloading.
